    The reason is partly because the provisions of the 2014 Housing Law are not in sync with the 2013 Land Law. To solve, according to Ms. Le, it is necessary to focus on adjusting planning policies, incentives, and fund use. support land; creating conditions not only for businesses and high-income people to access land, but also for the working class and manual workers to find housing in the urban center, convenient for travel. work and live.

    Vice Chairman of the People’s Council of Ho Chi Minh City also said that when the planning problem is solved, the supply and demand issue will also have a basis to gradually return to a stable trajectory, thereby controlling land prices and helping the land market. Land becomes stable, preventing speculation and corruption in the current land.

    Regarding regulations on specific land prices, as a member of the land price appraisal council of Ho Chi Minh City, Ms. Hanh said that “the mentality of the members is also very insecure”. The reason for the regulation does not state in which cases which land valuation method should be applied, but there are documents that apply different methods.

    “There is an opinion of the Economic Committee that all 5 methods should be applied, whichever method is reasonable will be chosen. But if using this option, there is an opinion that the council will cause damage to people if the land price is low, or if the highest level is chosen, it will affect businesses. In practice, the difference between these two methods is very large, and the specific method of determining land prices needs to create a safe and fair legal corridor for businesses, “Ms. Hanh said.

    In addition, the Deputy Director of the Ho Chi Minh City Department of Justice also said that the regulation “common land prices in the market” also has many problems, such as “appearing with the most frequency of land prices”, but many areas The area has very few transactions, or there is no speculative factor, how to determine?

    Delegate Tran Hoang Ngan (Ho Chi Minh City delegation) mentioned inadequacies in the issue of compensation and resettlement. “When buying a house, people go back and forth to survey, it is very difficult to calculate compensation elsewhere. Many projects such as markets, commercial centers, industrial parks… put in to recover people’s land are not good. If a socio-economic project is needed, negotiate with the people at market prices, or consider only the types of  agricultural land, limiting the acquisition of non-agricultural land and residential land of the people”, Mr. Ngan said.

    This delegate also mentioned the fact that, when meeting voters, people said that “the people’s land is suddenly planned as parkland, green trees and recovered at a very low price, while the next few meters are just a few meters away. For commercial land planning, the difference in compensation is too large”. While, according to Mr. Ngan, people in the commercial area still use the park, so they must share with those whose land has been confiscated to make the park to ensure fairness.
